Definitions
Compelling interest – exists where “government’s interest in the law and its purpose” is very strong when compared with “an individual’s constitutional right that is affected by the law” (Garner 2006, p. 121).
Disparity – availability of firms, usually socially and economically disadvantaged business enterprises, minority-owned business enterprises (MBE), or women-owned business enterprises (WBE), does not equal utilization in the procurement operations of an entity, usually governmental.
Disparity study – a research product that evaluates “statistical and anecdotal evidence of discrimination against M/WBEs to allow state or local policy makers to determine whether there was a ‘strong basis in evidence’…to adopt race-conscious remedies” (Wainwright and Holt 2010, p. 11).
